As an ILD Teleservices ("ILD"
or "we") customer and/or a visitor to our
website, your privacy is important to ILD. This statement
outlines how ILD handles information disclosed in conjunction
with use of the ILD Websites, including what type of
information is gathered and tracked, how the information
is used, and with whom the information is shared.
By becoming a registered user with ILD, by requesting
any of our free newsletters or bulletins, by purchasing
or using any of our services, or by otherwise utilizing
the ILD Websites, you agree to the use of the information
you disclose to us, including without limitation, your
personally identifiable information, in accordance with
this policy.
The Policy
The ILD Website Privacy Policy (this "Policy")
applies to all websites provided by ILD, namely, ILDtelecom.com news, information, products, advertising and directory
websites, including, but not limited to, ILDtelecom.com, ILDteleservices.com, Intellicalloperatorservices.com, 800rollcall.com, and ILDbnc.com (collectively, the "ILD Websites").
Changes to this Privacy
Statement
ILD may revise this Policy at any time, in its sole
discretion. In addition, from time to time, ILD may
use customer or registered user information for new
purposes not previously disclosed in this Policy. If
our information practices change we will post the policy
changes here to notify you of these changes, and if
appropriate, provide you with the ability to opt-out
of any new uses of your personally identifiable information.
You should periodically review this Policy for any such
changes.
WHAT INFORMATION DOES ILD GATHER AND/OR TRACK ABOUT YOU?
Personally Identifiable
Information
ILD Services: When you register for
any ILDteleservices.com services, ILD requires that you provide us with personally
identifiable information, including without limitation,
your full name, e-mail address, contact information,
and a unique subscriber login. ILD may also require
you to provide certain demographic information (e.g.,
whether you are a telecom provider or agent and for
what type of entity you work). We will use this information
for the purpose of fulfilling your request, including
contacting you if we have trouble processing your request.
You must also agree to any terms and conditions that
are applicable to the particular service for which you
register.
E-Newsletter: When you subscribe to
ILD e-mail information bulletins, ILD requires that
you supply your name and e-mail address so that we may
send the bulletins to you.
Service Related Announcements: When it is necessary
to do so, we will use your personally identifiable information
to send you service related announcements regarding
the ILD Websites or any services for which you have
registered. An example of a service related announcement
is a notification of a major change to the service or
scheduled maintenance downtime for the ILD Websites.
Generally, you may not opt-out of service related announcements,
and if you do not wish to receive such announcements,
you must deactivate your account with ILD.
Non-personally Identifiable
Information
ILD may also gather non-personally identifiable information,
which may be used by ILD and/or shared with third parties.
This information does not personally identify you but
may assist us in improving the services we offer. Generally
this information is collected through "traffic
data" and may entail the use of "cookies,"
"IP addresses," or other numeric codes used
to identify a computer. ILD does not link any of this
non-personally identifiable information to any of your
personally identifiable information.
While ILD may log IP addresses which indicate the location
of your computer on the Internet for systems administration
and troubleshooting purposes, ILD does not log IP addresses
to track your session. At the present time, ILD does
not make use of cookies in conjunction with operation
of the ILD Websites.
WITH WHOM DOES ILD SHARE YOUR INFORMATION?
ILD takes the privacy of its customers seriously. With
the exception of Service Related Announcements, discussed
above, and the situations discussed below, we provide
you with the ability to specify how we use your personally
identifiable information by use of our opt-out procedures,
as described in greater detail below.
ILD may, on occasion, choose to share your personally
identifiable information with select third parties whose
products or services ILD feels may be of interest to
its subscribers. While many of our subscribers find
these e-mail promotions valuable, if you prefer not
to have your personally identifiable information shared
with the third parties we select, please see the opt-out
procedure below.
Service Updates and E-Mail Promotions: Using the contact
information and e-mail addresses you provided during
registration, ILD periodically sends promotional messages
to notify its users about services offered by ILD and
to notify users of new features or changes that may
be made to the services. If you prefer not to receive
such promotional e-mail, please see the opt-out procedure
below.
Your personally identifiable information may be shared
with third parties, regardless of your opt-out status,
in the following instances:
Compliance with Law:
ILD may disclose personally identifiable information
if it is required to do so by law and when it believes
that such action is necessary to protect ILD's rights
and legitimate business interests or necessary to comply
with a judicial proceeding, court order or legal process
served on ILD.
Vendors: ILD
may on occasion use third party vendors to assist it
in performing its business functions, such as mailing
statements to subscribers, editing user lists, and providing
customer service. Personally identifiable information
may be shared with these third party vendors for purposes
of allowing them to perform their assigned functions.
Organizational Changes:
In the event ILD undergoes a business transition such
as a sale, merger, consolidation, change in control,
transfer of substantial assets, reorganization or liquidation,
ILD’s accumulated customer information, including your
personally identifiable information, will be treated
as an asset and, like other business assets, subject
to transfer to or acquisition by a third party.
Correspondence with
ILD: Any correspondence that you send to ILD,
such as e-mails or letters, and any correspondence other
users or third parties send to ILD about your activities
or postings on the ILD Websites, will be collected and
stored in a file specific to you. All submissions to
ILD become property of ILD.
HOW IS THE INFORMATION
USED BY ILD?
In addition to the uses described above, ILD may use
your information for the following purposes:
Statistical Analysis:
ILD may perform statistical analyses of user behavior
in order to measure interest in the various areas of
the ILD Websites. This analysis will be used for purposes
such as product development. We may share the results
of this statistical analysis, in aggregate form without
any personally identifiable information, with third
parties.
Account Maintenance:
ILD may utilize the contact information you provided
at registration, such as your telephone number and e-mail
address, to contact you regarding your account status
or changes to the subscriber agreement, and to confirm
your registration.
LINKS TO OTHER WEBSITES
The ILD Websites contain links to third party websites
that are not owned or controlled by ILD. ILD does not
review and is not responsible for the content or the
privacy policies of websites to which the ILD Websites
may link. This Policy applies solely to information
collected by ILD on the ILD Websites. You are encouraged
to review the privacy policies of all websites to which
you link from the ILD Websites.
GOVERNING LAW AND A SPECIAL
NOTE ABOUT NON-U.S. USERS
All users, including those users who access the ILD
Websites from a country other than the United States,
agree that the laws of the United States, the State
of Florida shall govern any dispute, including those
arising from ILD's use of personally identifiable information
or otherwise relating to this Privacy Policy.
OPT-OUT PROCEDURES; CORRECTIONS
AND CANCELLATIONS
If you are a registered user with ILD, you may manage
your promotional e-mail preferences by opting-out of
certain types of e-mail contact from ILD (except for
those contacts specified in this Policy from which you
may not opt-out) and from having your personally identifiable
information shared with third parties. Should you wish
to make or change any such opt-out selections, send
an email with the details of your request to info@ildmail.com.
If you are a direct ILD customer or an ILD agent, when
you have a change in your personally identifiable information,
or if you no longer desire to receive our services or
any portion of our services, you may notify us by sending
an email with the details of your request to info@ILDmail.com or by contacting customer
service. We reserve the right to take reasonable
steps to confirm the new information or cancellation
of services, including, by contacting you directly.
If you are a customer who obtains ILD's services through
one of ILD's agents, you must contact your agent in
order to change your personally identifiable information
or to cancel or change the services for which you are
registered.
GENERAL TERMS AND CONDITIONS
We may prohibit or enjoin any conduct or use of the
ILD Websites that restricts or prevents other users
from using the ILD Websites, and we have the right to
deny access to anyone that we deem unfit to use the
ILD Websites for any reason. Notwithstanding the above,
we have no obligation to monitor the use of the ILD
Websites, but we reserve the right to do so.
ALL INFORMATION ON THE ILD WEBSITES IS PROVIDED "AS
IS" AND WE MAKE NO WARRANTY OR GUARANTEE, EXPRESS
OR IMPLIED, ABOUT THE ACCURACY, COMPLETENESS, TIMELINESS,
OR CORRECTNESS OF THE INFORMATION AND MATERIAL CONTAINED
ON THE ILD WEBSITES. WE EXPRESSLY DISCLAIM ALL WARRANTIES
REGARDING THE ILD WEBSITES, THE MATERIAL AND INFORMATION
ON THE ILD WEBSITES OR YOUR ABILITY TO ACCESS AND USE
THE ILD WEBSITES, INCLUDING WITHOUT LIMITATION WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
AND NON-INFRINGEMENT.
When you are using the ILD Websites, information that
you submit will be transmitted via the internet and
such transmission is beyond the control of ILD. ILD
assumes no liability for or relating to the delay, failure,
interruption, or corruption of any data or other information
transmitted in connection with use of the ILD Websites.
Nothing on the ILD Websites shall be deemed to create
any contract between us and you or to give you any rights
against us for damages of any kind, whether direct,
indirect, or consequential. Under no circumstances shall
ILD, its subsidiaries, affiliates, officers, directors,
employees, agents or representatives be liable for direct,
indirect, incidental, special or consequential damages
that result from the use of or the inability to use
the ILD Websites, even if we have been advised of such
a possibility. If you are dissatisfied with any materials
or information provided on the ILD Websites, your sole
and exclusive remedy is to discontinue using the ILD
Websites.
